These Terms of Service govern the use of the Roxy’s Pet Shop website and purchases made from Roxy’s Pet Shop Ltd.

By using our website or purchasing from us, you agree to these terms where applicable.

Nothing in these terms excludes or restricts your statutory rights under UK consumer law.

2. Use of Our Website

You may use our website for lawful purposes, including:

  • Viewing our products and livestock;

  • Checking livestock availability and prices;

  • Reading our animal care guides;

  • Contacting us;

  • Purchasing eligible products; and

  • Obtaining information about Roxy’s Pet Shop.

You must not knowingly misuse our website, attempt to gain unauthorised access to it or use it for fraudulent or unlawful purposes.

3. Website Information

We make reasonable efforts to ensure information displayed on our website is accurate and up to date.

However, information may occasionally contain errors or become outdated.

Product photographs and animal photographs are intended to provide a reasonable representation. Colours, markings, size and appearance may vary, particularly with live animals.

Where an obvious error has been made in a price, description or other information, we reserve the right to correct it.

Nothing in this section affects your statutory rights.

4. Livestock Availability

Live animal availability can change quickly.

Although we aim to keep our website updated, an animal appearing on our website does not guarantee that it will still be available when you visit the shop.

Animals may be sold, reserved, temporarily unavailable or removed from sale for welfare or other appropriate reasons.

Customers are welcome to contact us before travelling to check current availability.

5. Live Animal Sales – In-Store Collection Only

Live animals are available for in-store collection only.

We do not send live animals through standard postal or parcel delivery services.

Where our website allows an enquiry, reservation or other online interaction relating to livestock, this does not remove our requirement to ensure that the proposed home and care arrangements are appropriate before completing the animal sale.

Collection must take place from:

Roxy’s Pet Shop
204 High Street
Bloxwich
Walsall
WS3 3LA

6. Animal Welfare & Suitable Setups

Animal welfare is our highest priority.

Before selling an animal, we may require evidence that appropriate accommodation and equipment are already in place.

Depending on the species, this may include photographs or videos showing:

  • The complete enclosure;

  • Suitable enclosure dimensions;

  • Heating equipment;

  • Thermostatic control;

  • UVB and lighting;

  • Substrate and furnishings;

  • Hides and enrichment;

  • Filtration;

  • Water conditions; and

  • Other equipment necessary for the species.

Customers should provide accurate information when discussing their proposed setup and care arrangements with us.

We Reserve the Right to Refuse an Animal Sale

Roxy’s Pet Shop may refuse or postpone the sale of a live animal where we reasonably believe that completing the sale would not be appropriate for the animal's health or welfare, or where applicable legal or licensing requirements are not satisfied.

This may include situations where:

  • Suitable accommodation has not been provided;

  • Required heating, lighting, UVB or thermostatic control is missing;

  • An aquarium has not been appropriately prepared or cycled;

  • The proposed enclosure is unsuitable;

  • We have reasonable welfare concerns;

  • Required documentation cannot be provided; or

  • Completing the sale would conflict with our legal or licensing responsibilities.

The welfare of the animal will always take priority over completing a sale.

7. Responsibility for Animal Care

Customers purchasing an animal are responsible for understanding and meeting its ongoing welfare requirements.

These may include:

  • Suitable accommodation;

  • Correct diet;

  • Fresh water;

  • Heating and temperature control;

  • Humidity;

  • UVB and lighting;

  • Hygiene;

  • Enrichment;

  • Appropriate social requirements;

  • Water quality and filtration;

  • Veterinary treatment where required; and

  • Other species-specific care.

Our staff and care guides can provide general husbandry information, but customers remain responsible for providing appropriate ongoing care.

8. Sexing of Animals

Where we provide information regarding the likely sex of an animal, we take reasonable care to provide accurate information.

However, some species can be difficult to sex accurately, particularly when young.

Unless confirmed by an appropriate reliable method, we cannot guarantee the sex of every animal with 100% certainty.

Where applicable, DNA sexing or other specialist testing may be available.

9. Animal Documentation

Certain species may require specific documentation, identification or certification.

Where legally required, relevant documentation will be provided or handled in accordance with applicable requirements.

Customers are responsible for keeping any documentation supplied with an animal safe and complying with any continuing legal requirements associated with ownership of the species.

10. Prices

Prices are displayed in Pounds Sterling (GBP) and include VAT where applicable.

We reserve the right to change prices at any time before a purchase has been completed.

Prices may differ between products, individual animals, colour variations, mutations, ages or other legitimate factors.

If an obvious pricing error occurs, we may correct the error before accepting or completing the transaction.

11. Promotions & Special Offers

Promotional prices and special offers may:

  • Be available for a limited period;

  • Apply only to selected products or animals;

  • Be subject to availability;

  • Be restricted to specified dates; and

  • Have additional conditions stated with the promotion.

Unless otherwise stated, promotions cannot necessarily be combined with other offers.

We may withdraw or amend a promotion before a purchase is completed, provided doing so does not affect a contract already formed or a customer's statutory rights.

12. Orders & Payments

Where eligible products can be purchased through our website, payment must be made using one of the payment methods offered at checkout.

Submitting an order does not necessarily mean that it has been accepted.

Where applicable, an order is accepted when we confirm acceptance or otherwise fulfil the order.

We may decline or cancel an order where there is a legitimate reason, including:

  • An item being unavailable;

  • An obvious pricing or description error;

  • Payment not being authorised;

  • Suspected fraud; or

  • A legal or regulatory reason preventing us from completing the transaction.

If payment has already been taken for an order that we subsequently cancel, an appropriate refund will be provided.

13. Returns & Refunds

Returns, refunds and exchanges are governed by our separate Return & Refund Policy.

In particular, live animals are not accepted as change-of-mind returns.

Purchasing an animal should not be considered a trial period.

Our voluntary 48-hour live-animal health guarantee is additional to, and does not restrict, customers' statutory rights.

Please refer to our Return & Refund Policy for full details.

14. Online & Distance Purchases

Customers purchasing eligible goods online may have cancellation rights under applicable UK consumer legislation.

Where those rights apply, information about cancellation and returns is provided in our Return & Refund Policy.

Different rules apply to purchases made physically in store where there is no legal change-of-mind cancellation right unless otherwise provided by law or by our voluntary returns policy.

15. Care Guides & Advice

Information provided by our staff, website and care guides is intended to provide practical general guidance.

Animal-care requirements can vary depending on species, age, health, environment and individual circumstances.

Our care information is not a substitute for professional veterinary diagnosis or treatment.

If an animal is ill or injured, customers should seek advice from a suitably qualified veterinary surgeon where appropriate.

16. Intellectual Property

Unless otherwise stated, the content of this website, including:

  • Roxy’s Pet Shop branding;

  • Logos;

  • Text;

  • Original photographs;

  • Graphics;

  • Care guides; and

  • Other original website content

belongs to Roxy’s Pet Shop Ltd or is used with appropriate permission.

Content must not be copied, reproduced, republished or commercially exploited without permission, except where permitted by law.

17. Third-Party Links

Our website may contain links to websites or services operated by third parties.

These links may be provided for convenience or information.

We are not responsible for the content, availability, security or privacy practices of third-party websites.

18. Liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so.

We are not responsible for losses that were not reasonably foreseeable or for losses resulting from circumstances outside our reasonable control, except where the law provides otherwise.

Nothing in these Terms of Service excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which cannot lawfully be excluded.

19. Privacy

Our collection and use of personal information is explained in our separate Privacy Policy.

By using our website, personal information may be processed as described in that policy.

20. Changes to These Terms

We may update these Terms of Service from time to time.

Any updated version will be published on our website.

Changes will not retrospectively remove rights that customers already have in relation to completed purchases.

21. Governing Law

These terms are governed by the applicable laws of England and Wales.

Consumers will retain any mandatory rights regarding where legal proceedings may be brought.
